These Terms & Conditions apply to access to and use of the website arcawellness.com and the purchase of products from ARCA. By accessing the website, placing an order, or using ARCA's support services, customers are deemed to have read, understood, and agreed to these Terms & Conditions.

1. Introduction and product scope

ARCA provides wellness devices, including but not limited to red light devices, light therapy masks, panels, mats, accessories and related products. The product range may include consumer goods and products classified as medical devices depending on each product and applicable law.

2. ARCA's rights

ARCA may issue, revise and update transaction terms; publish/update product, price and campaign information; request information necessary to confirm orders, delivery, payment and complaints; and protect website content, images, designs, trademarks, logos, data and IP.

ARCA may refuse or cancel an order if information is incomplete/inaccurate, the customer cannot be contacted for confirmation, fraud/forgery/illegality is suspected, stock is unavailable, business has stopped, or force majeure applies. ARCA may also suspend risk-flagged payment or delivery orders until adequate verification is completed.

3. ARCA's obligations

ARCA must disclose accurate product, price, promotion, payment, delivery, returns, warranty and transaction terms before ordering; keep the website stable; protect customer data; supply goods as published; issue lawful invoices/documents; receive and resolve complaints; and perform tax and legal duties.

4. Customer rights and obligations

Customers may receive full information; choose products, payment and delivery methods; have their data protected; and raise questions/feedback/complaints.

Customers must provide accurate information, pay on time, cooperate with delivery and inspection, and avoid fraud, forgery, IP infringement, malware or other unlawful acts.

5. Product liability

ARCA products are wellness devices designed to support skincare, recovery, relaxation or wellness routines according to each product's instructions. Nothing in these Terms excludes or limits mandatory consumer rights or ARCA's mandatory liability for death or injury caused by product defects.

To the extent permitted by law, ARCA is not responsible for indirect damages, unexpected consequential damages, data loss, loss of profits, business interruption, or other damages arising from use of the website, misuse of the product, or failure to comply with the instructions for use.

Nothing in these Terms & Conditions is intended to exclude or restrict consumer rights under current legal regulations.

To the extent permitted by applicable law, ARCA is not responsible for injury or loss caused by a customer''s failure to read the manual, follow the instructions, or any unauthorised modification, installation or use outside the product guidance.

ARCA’s liability, if any, will be considered within the scope of the specific transaction, published policies, and applicable legal regulations.

In all cases of dispute, except cases causing damage to life or health due to a direct product defect as prescribed by the Law on Protection of Consumer Rights, ARCA’s maximum compensation liability will not exceed the total order value paid by the Customer. ARCA is not responsible for any indirect damages or lost profits of the Customer.

6. Third-Party Links

The ARCA website may contain links to third-party websites, platforms, or services.

These links are provided to support the Customer experience. ARCA does not control and is not responsible for the content, policies, activities, or security level of such third-party websites, platforms, or services.

Customers should carefully read the terms and policies of third parties before use.

7. Personal data protection

The collection, use, storage, and protection of Customers’ personal information are carried out in accordance with ARCA’s Privacy Policy published on the website. ARCA is committed to protecting Customers’ personal data, including sensitive data relating to health/images, in accordance with Law No. 91/2025/QH15.

By using the website or placing an order, Customers confirm that the information provided to ARCA is accurate and agree that ARCA may process the information in accordance with the current Privacy Policy. Details of Customers’ rights are provided in the Privacy Policy published on the Website.

8. Intellectual property

Brand names, logos, images, videos, text, designs, interface, data and product materials are lawfully owned or used by ARCA. No copying, modification, distribution, republication or commercial use is allowed without written consent.

9. Complaints and disputes

Customers may contact hello@arcawellness.com or 097 839 9921. ARCA prioritises intake, verification and good-faith resolution. If unresolved, disputes are handled under Vietnamese law by the competent authority.

ARCA is not responsible for any delay or inability to perform obligations if the cause arises from events beyond ARCA’s reasonable control, including but not limited to natural disasters, epidemics, fires, floods, war, strikes, transportation interruptions, system incidents, power outages, Internet interruptions, changes in policies of state authorities, or other force majeure events.

In the event of force majeure, ARCA will make efforts to notify and coordinate with Customers to find an appropriate handling solution.

10. Changes

ARCA may update these Terms. The new version is effective on publication or the stated notice date. Confirmed orders remain governed by the version applicable at confirmation unless mandatory law requires otherwise.
